Terms of Service

1. Eligibility and accounts

You must be at least 13 years old to use EMO, and if you are under the age of majority where you live, you should use EMO with a parent or guardian. You are responsible for your account, for keeping your login secure, and for the activity that happens under your account. Please provide accurate information and keep it up to date.

2. The Service

EMO lets you record daily emotional check-ins, view trends and weekly recaps, receive AI-generated insights, and optionally share selected, sanitized updates with a private Circle of people you invite. We may add, change, or remove features over time.

3. EMO Pro, billing, and trials

EMO offers a free tier and a paid subscription, EMO Pro. Pro is available on a monthly or annual plan and includes a 14-day free trial for new subscribers.

Trial. If you start a trial, you will not be charged until the trial ends. If you do not cancel before the trial ends, your subscription begins and your payment method is charged the then-current price.

Renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) until you cancel. The price for renewals is the price shown at sign-up unless we notify you of a change in advance.

Cancellation. You can cancel anytime from your profile, which opens our payment processor's billing portal. When you cancel, you keep Pro access through the end of the period you already paid for, and you will not be charged again.

Refunds. Except where required by law, payments are non-refundable. Because of the free trial, you can evaluate Pro before being charged.

Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms as they apply to your payment.

4. Acceptable use and Circle conduct

EMO is a supportive space. You agree not to use the Service to harass, threaten, abuse, or harm others, to violate anyone's rights, to share unlawful content, or to interfere with or attempt to break the Service. Within Circle, treat the people who let you into their lives with care. We may filter or remove abusive messages and may suspend accounts that violate these Terms.

5. Your content

Your check-ins, notes, and journal entries are yours. You grant us a limited license to store and process them solely to operate the Service for you (including AI analysis as described in our Privacy Policy). We do not claim ownership of your content and we do not sell it.

6. Not medical advice

EMO is a self-reflection and wellbeing tool. It is not a medical device, and it does not provide medical, psychological, or therapeutic advice, diagnosis, or treatment. EMO is not a substitute for care from a qualified professional. If you may be experiencing a mental health condition, please consult a professional.

Crisis. EMO is not an emergency service. If you are in crisis or may be in danger, contact your local emergency number or a crisis line right away. In the US, you can call or text 988 (Suicide & Crisis Lifeline).

7. Intellectual property

The Service, including its software, design, and brand, is owned by EMO and protected by law. We grant you a personal, non-transferable, non-exclusive right to use the Service under these Terms. You may not copy, modify, resell, or reverse-engineer the Service except as permitted by law.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that insights will be accurate for your situation.

To the fullest extent permitted by law, EMO will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

9. Termination

You may stop using EMO and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other people. On termination, the sections of these Terms that by their nature should survive will continue to apply.

10. Changes to these Terms

We may update these Terms as EMO evolves. When we make material changes, we will update the date above and, where appropriate, notify you in the app. Continuing to use EMO after changes take effect means you accept the updated Terms.
